Briefly:

  • The Court yesterday allowed Texas to proceed with interim electoral maps drawn by a three-judge panel of the U.S. District Court in San Antonio, rejecting a stay application filed by the League of United Latin American Citizens.  Adam Liptak has coverage for The Caucus blog of The New York Times.
  • The “papers, please” provision of S.B. 1070, the Arizona immigration law at issue in last Term’s decision in Arizona v. United States, is now in effect, after U.S. District Judge Susan Bolton issued an order that officially dissolved a preliminary injunction barring implementation of the provision.  Capitol Media Services has coverage (via the Arizona Daily Sun).
  • In her column for the Opinionator blog of The New York Times, Linda Greenhouse discusses whether the mandatory observance of Constitution Day – required for all educational institutions receiving federal funds – may be unconstitutional after the Court’s ruling in the health care case that the Medicaid expansion provision violated the Constitution.
  • Damon W. Root of Reason discusses the issues raised by Arkansas Game and Fish Commission v. United States, in which the Court will consider whether government actions that impose recurring floods on private property constitute a taking.
  • Annie Sweeney of the Chicago Tribune has the latest update on the ongoing “war of words” between Justice Scalia and Judge Richard Posner of the Seventh Circuit.
  • Speaking yesterday at the University of Colorado at Boulder, Justice Ginsburg predicted that the Court would consider the constitutionality of the federal Defense of Marriage Act “toward the end of the current Term.”  Coverage comes from the Associated Press (via The Huffington Post).
